1. About Swapped

Swapped is an independent digital matching service intended to help teachers identify potentially compatible direct or multi-party swap opportunities based on information and preferences supplied by users. Swapped is not an official TSC website, is not operated by TSC, and does not replace the official transfer, approval or verification processes required by TSC or any other relevant authority.

2. Acceptance of these Terms

By creating an account, activating a swap profile, browsing teacher swap information, using a match, or otherwise using Swapped, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the service.

3. Eligibility and account responsibility

You must provide information you are lawfully entitled to provide and must be legally capable of using the service. Teacher accounts are intended for the teacher represented by the account. You are responsible for safeguarding your password and for activity carried out through your account.

You must not impersonate another teacher, create misleading accounts, share login credentials for misuse, or attempt to gain unauthorized access to another person's account or administrative features.

4. Accuracy of teacher and swap information

You are responsible for keeping your profile and preferences accurate and current, including your station, institution type, teaching level, subjects, job group/grade, employment/confirmation status and target destinations. Matching quality depends on this information.

Swapped may provide profile-expiry and reconfirmation tools to reduce stale listings. If you are no longer looking for a swap, pause your search or report a successful swap promptly.

5. Matching is an introduction, not an approval

A direct match, three-way match, Swap Profiles listing or other compatibility result is an informational introduction generated from available platform data. It is not a representation that every fact supplied by another user has been independently verified, and it is not an official transfer offer, approval, appointment or guarantee.

Teachers remain responsible for confirming the other party's details and eligibility and for following all applicable TSC procedures, policies, approvals and documentation before relying on or acting on a potential swap.

6. Regular and SNE institution compatibility

Swapped distinguishes Regular and Special Needs Education (SNE) institutions because the categories affect meaningful swap compatibility. Users must select the institution category and teaching level that accurately describe their current placement. The platform may use these values as hard matching conditions, but users remain responsible for official eligibility verification.

7. Swap Profiles directory

Where enabled by the administrator, signed-in teachers may browse active swap profiles containing limited professional and preference information such as current station, subjects, institution type, teaching level and target destination. The directory is intended only to help teachers assess possible swap opportunities.

You must not scrape, harvest, reproduce in bulk, republish, sell, profile, spam or use directory information for recruitment, marketing, harassment, fraud or any purpose unrelated to legitimate teacher swap activity.

8. Contact information and communication between teachers

Contact details may become available through an applicable match workflow so teachers can discuss a potential swap. If you receive another teacher's information, use it only for the relevant swap discussion, communicate respectfully, and do not disclose it publicly or to unrelated third parties without permission.

9. Prohibited conduct

You must not use Swapped to submit false information, misrepresent employment or posting status, harass or threaten others, send unsolicited commercial messages, attempt fraud, upload or transmit malicious code, interfere with platform security, bypass access controls or rate limits, automate unauthorized extraction of data, or use the service in a way that violates applicable law or the rights of another person.

10. Notifications and email

Swapped may send service communications including password-reset messages, match notices, profile-expiry reminders and other account information. Administrators may also send non-essential campaigns to eligible users. Campaign messages provide an unsubscribe option; unsubscribing from marketing does not disable essential security or service notifications.

11. Social media, Facebook groups and WhatsApp communities

Swapped may publish links to official social-media profiles, Facebook groups, WhatsApp groups and WhatsApp channels. Participation is optional and may be subject to the rules, privacy practices and technical controls of the third-party service hosting the community. A link appearing on Swapped does not change the fact that Facebook, WhatsApp or another external provider operates its own platform.

Use community spaces carefully. Do not publish passwords, National ID numbers, TSC numbers or unnecessary private information, and do not assume that a message posted by another community member has been verified by Swapped.

12. Successful-swap reporting

Swapped may ask whether a match resulted in a successful swap. A teacher's confirmation is treated as that teacher's report and may close or pause their active search. It does not automatically prove official transfer approval or mark another teacher as successful without that other teacher's own confirmation where the platform requires separate confirmation.

13. Account moderation, suspension and access

Swapped may review, restrict, pause, deactivate or suspend accounts or matching activity where reasonably necessary to protect users, investigate suspected misuse, enforce these Terms, maintain security, comply with law, or address inaccurate or abusive use of the service. We may preserve records reasonably required for security, audit, dispute-resolution or legal purposes.

14. Availability and changes to the service

We aim to keep Swapped reliable, but the service may occasionally be unavailable for maintenance, upgrades, failures or circumstances outside our reasonable control. Features, matching logic, eligibility fields and administrative controls may be improved over time. We will not intentionally make material changes retroactive in a way that unfairly removes rights already accrued under applicable law.

15. No warranty of transfer outcome

To the extent permitted by law, Swapped is provided on an “as available” basis. We do not warrant that a match will result in communication, agreement, TSC approval, transfer, placement or any specific outcome. Teachers should independently verify information and use official channels before making employment, relocation or financial decisions.

16. Limitation of liability

To the maximum extent permitted by applicable law, Swapped will not be responsible for indirect, consequential or special losses arising solely from reliance on a proposed match, another user's inaccurate information, third-party community content, or a decision by TSC or another authority. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

17. Intellectual property

The Swapped name, branding, site design, software and original platform content are protected by applicable intellectual-property laws. These Terms give users permission to use the service for its intended purpose; they do not transfer ownership of Swapped's software, branding or content.

18. Privacy

Our Privacy Policy explains how personal data is collected, used, protected, shared and retained. It forms part of the terms governing your use of the service.

19. Changes to these Terms

We may update these Terms to reflect changes to Swapped, security needs, legal requirements or operational practices. The current version will be posted here with its effective date. Where a change is material, we may also provide additional notice through the website or email.

20. Governing law

These Terms are governed by the laws of Kenya. Any dispute should first be raised with Swapped in good faith so the parties can attempt to resolve it. Nothing in this section limits a right to approach a competent regulator, tribunal or court where applicable.
